NDOJ Quinn says she talked with outside counsel, Ray Kelly, regarding payments to shareholders. He has concerns about Navajo privacy Act & what info can be shared. I need to research Navajo Privacy Act. There are questions about whether Navajo govt enterprises are considered Navajo govt entity.
There was question raised who NOG shareholders are. They are: Otto Tso, Seth Damon; Herman Daniels; Charlaine Tso; Elmer Begay
Speaker Otto Tso says NOG shareholders are selected by standing committee and approved by Council. He asks attorneys to make sure that they include legislation appointing the NOG shareholders, which shows appointments were done according to law.
Delegate Crotty asked if appointments allowed stipends, etc?
Speaker Tso says legislation approves shareholder and that’s it. And then the shareholders abide by bylaws. NDOJ Quinn can get that info for you.

Navajo chairman convicted in kickback scandal
WINDOW ROCK, Ariz. — Suspended Navajo Tribal Chairman Peter MacDonald was convicted Wednesday of 41 counts of bribery, conspiracy and violating tribal ethics standards.
MacDonald’s son, Peter ‘Rocky’ MacDonald Jr. was convicted of 23 counts alleging that he acted as the middleman for his father in a scheme to collect kickbacks from companies doing business on the nation’s largest Indian reservation.
The MacDonalds were accused of conspiring to obtain an estimated $250,000 in kickbacks from 1986 to 1988.
A tribal court jury, after deliberating about 15 hours since Monday evening, acquitted the elder MacDonald of one count involving his son’s consulting business. Three other counts against him were dismissed during the trial because of insufficient evidence.
MacDonald Sr., 61, faces fines ranging from $250 to $500 and up to 180 days in jail for each count. Sentencing was scheduled for Monday.
Tribal Judge Robert Yazzie said the law also requires that anyone convicted of such crimes forfeit tribal office and be barred from holding office for four years.
MacDonald was suspended as chairman in February 1989 by the Tribal Council, pending an investigation into allegations of corruption raised before the Senate Select Committee on Indian Affairs. The ousted chairman is seeking re-election in the Nov. 6 General Election.
Outside the courtroom Wednesday, MacDonald said, ‘I am the chairman of the Navajo Nation. If you want a statement from me, vote for MacDonald and Dr. George P. Lee (his running mate) on Nov. 6, period.’
He declined further comment.
Defense attorney Val Jolley said he expects MacDonald to appeal the convictions and that he believes MacDonald remains chairman unless impeached by a two-thirds vote of the Tribal Council.
Mark Donatelli, special prosecutor in the case, said the verdict showed that ‘the Navajo Nation wants to start over with a clean slate of honest politicians, to give every Navajo a chance to participate in the political process.’
Ned McKensley, a MacDonald supporter, said Donatelli was hired by outsiders — ‘the Bureau of Indian affairs, the Senate Select Committee and those people.’
MacDonald Sr. is facing two more trials, one on numerous counts of violating tribal election laws and another in which he is accused of conspiring to defraud the tribe in the 1987 purchase of the Big Boquillas Ranch in northern Arizona.
Two non-Indians were indicted last week by a federal grand jury in Phoenix on charges of laundering money stemming from their purchase of the ranch and its sale on the same day to the Navajo Tribe for a profit of $7.2 million.
5:31 pm, 12.29.20, This purchase of 6,000 acre Chavez Ranch for $19 million was not negotiated by the Navajo Nation Land Dept, Navajo Environmental Protection Agency, Navajo Nation Mineral Dept, Delegate Jamie Henio was the sole negotiator with the Chavez Ranch family for the 6,000 ranch for $19M.
During the debate on Legislation 0241-22, it was reported to the Budget & Finance Committee that the Chavez Ranch was appraised at $4M and $10M. And so why would the Navajo Council buy the Chavez Ranch for $19, based on the Word of a LAME DUCK delegate, who decided to negotiate a $19M land deal on his own.
5:40 pm, 12.29.22, Delegate Amber Crotty asks if the use of the principal of the Navajo Nation Land Acquisition Fund to buy the Chavez Ranch requires the approval of all of the 110 chapters.
Navajo Dept of Justice reports to Delegate Crotty that there is No language that requires the use of the Principal of the Navajo Land Acquisition Fund to go before Navajo voters before it can be used.
Delegate Jamie Henio says that the Controller’s memo in his legislation reported that the Navajo Land Acquisition Trust Fund balance is $195M
5:45 pm, 12.29.22, Delegate Jamie Henio, in his campaign for the Council to buy the 6,000 acre Chavez Ranch by Tohajiilee, informed the Council that the Chavez Ranch comes with 400 acre feet of water. BUT Delegate Henio did not tell the Council that the 400 acre feet of water has Salt!
5:52 pm, 12.29.22, Delegate Amber Crotty says she has a question for the navajo justice dept regarding how Navajo Nation Land Acquisition Fund created? Settlement? What is Tohajiilee contributing to the Navajo Nation General Fund regarding overcrowding, area for livestock, plan for future generations.
Delegate Henio sounds like he’s the land broker for Chavez Ranch…He defends his Failure to Work with Land Dept because Land Dept didn’t talk to him & President Nez wasn’t signing Letter of Intent for the Navajo Nation to Buy the Land. Henio says that once Nez signed the Letter then the Due Diligence would begin. He also says that when Land Dept Director Mike Halona makes his presentation to the Council that Halona will probably undermine his Plan to Buy Chavez Ranch by reporting to the Council about appraisals that are lower than $10M
6 pm, 12.29.22, Navajo land Dept director Mike Halona said that the dept started working on Chavez Ranch and then COVID hit. But then we had an appraisal done which showed $4,575,000 appraisal. But then another appraisal came in at $10M, which put us in a position to negotiate between $4M nd $10M.
Delegate Crotty asks for documents/appraisals to be sent to Council and explanation of how Speaker’s Office paid for appraisal.
Navajo dept of justice says that the question regarding payment from speaker’s office for appraisal should go to Chief Legislative Counsel Dana Bobroff.
Delegate Rickie Nez asks for Halona to finish his presentation.
Speaker Tso says Point of Privelege must be addressed first.
CLC Dana Bobroff says power and duties of speaker set by law and I think most probably the speaker’s power to have appraisal done goes with supervising employees. I dk much about process of hiring appraiser, but speaker’s office hires consultants that supports request from delegates. There is nothing specific in speaker’s power to hire appraiser. Does not strike me that he was out of line for doing that but I would need to look at process.
6:14 pm, 12.29.22, Navajo Land Dept Director Mike Halona continues his presentation: Our duty is to make sure that these Land Acquisition funds handles correctly. It appears we are buying 6,000 acres but it is only 1,881 acres.
Halona reported that the Chavez ranch is 6,349 acres but the Navajo Nation would only be able to buy 1,881 acres. And 4,456 aces is NM land and BLM land and are between Chavez ranch and on north side of Tohajiilee. We need to talk about the correct acreage if buying.
And he says there is a Large pueblo ruin, hummingbird pueblo, in middle.
Regarding Water Rights, Halona reported that the appraiser drilled 27000 and not produce 400 acre feet of water. Can’t get that amount so that value not in appraisal. Water is not quality water and would have to build large water treatment. At Rt 66, they had to do that.
He said One area that remain unclear on is Access. Part of Chavez ranch goes through Laguna land. The Nation was Told that there is a agreement to go through land but need guarantee that go through 50 acres to get to Chavez ranch.
6:21 pm, 12.29.22, Delegate Jamie Henio says he was driving back to Gallup. I went this route because Land dept not talking to me and President Nez, which is why we need to sit down and sign letter of intent so we talk to them about issues with land, which is in our rights as council delegates.
Henio says that asking to use principal is up to council. The state land lease are part of the sale and when buy land then get state leases, he says. And we can do land swaps. The land dept is just thinking one way and that is not to buy state land.
NOTE – Delegate Henio obviously missed the Report by Land Dept Director Halona that the Chavez Ranch purchase does not include the state leases, which have to be approved through the state.
Navajo dept of justice says that among the Navajo laws that Delegate Jamie Henio is waiving in his legislation is the required 2/3 vote of the Council to approve buying the Chavez Ranch for $19M.
6:35 pm, 12.29.22, Delegate Crotty asks for institutional history on whether what Delegate Jamie Henio did has been done, including the waiving of several Navajo laws for this purchase.
Controller Robert Willie reported to the Council that the reason that $19M of the Principal of the Land Acquistion Trust Fund was being proposed to buy the Chavez Ranch was because the balance of the Land Acquistion Fund is $1M.
Delegate Eugenia Charles-Newton says that she didn’t know that the speaker’s office got involved by paying for appraisal for Chavez Ranch and that does not appear to be right. I motion to Table until get more info and for the 25th Council to address. SECONDED by Delegate Crotty.
Delegate Jamie Henio says this is an opportunity to expand the land base of Tohajiilee and by tabling then take four years to drop as legislation. So what happens when Laguna buys the Chavez Ranch. He said he heard Land Dept complaining about lost opportunities around Twin Arrows. Albuquerque expanding and they will need land for industry. And agree with Delegate Daniel Tso that if Navajo buys and then that is guarantee that there will be access to land through Laguna land.

Delegate Jamie Henio says there are two working windmills on state land, ranch house, corrals, holding pen. There is 400 acre feet of water for new owner. Without water, you cannot develop. NOTE – the 400 acre feet of water has salt!

We learned from Colorado Ranch that not everything that glitters is goald. There were promises that community could access Colorado Ranch.
Land Acquisition Fund is for entire reservation and Navajo Nation laws regarding how land is purchased. This legislation to buy land is completely out of order.

Delegate Herman Daniels cites page 11 of 12, line 6, it clearly states why 0276-22 is an Emergency because Nation unable to assert sovereignty on land that Gouldings is located on. This seller of Gouldings is only allowing us up to the end of year. In 2023, seller will open to other buyers. We have been working on with land dept since 2012 when it was offered to Nation and didn’t go through. Five delegates toured the property.
Delegate Crotty says this property is not owned by Nation and this issue is chronic issue across the Nation. I am offended that use this provision when just for land purchase. I ask that we partner on jurisdiction issue for victims of crime.

9:13 pm, 12.29.22, Speaker Otto Tso calls for a 1-hour Recess after Delegate Rickie Nez suggests that Council take a one-hour Recess since Council connection on social media needs to be rebooted. Speaker Tso informed Council about the need for social media connection to be rebooted.
But as soon as Speaker Tso calls for Recess, Delegate Nathaniel Brown says he’s been waiting patiently for his legislation, and he’s been helping a family that lost their roof to a tornado that touched down in Dennehotso two days ago. He also mentions how Delegate Rickie Nez said he would delay Council.

They were adding and taking Legislations off their CONSSENT AGENDA, which was Delegate Rickie Nez’s brainchild to get as many Legislations approved with a CONSENT AGENDA, especially Controversial Legislation. But the Plan backfired because Delegates took Legislation off the Consent Agenda, but Speaker Tso then allowed delegates to add those Same Legislations back on the CONSENT AGENDA….LOL LOL LOL LOL And as I listened to the CONSENT AGENDA FIASCO, I knew the Council would continue to be their Own BEST Enemy.
