Navajo Council debating Legislation 0352-13 which is for Navajo Oil and Gas to renew its federal charter. Council took recess for attorneys to do legal research.

Definition of quorum by law does not require delegate to vote and council has counted speaker for quorum.
Rule 22: regarding conflict of interest and voting, a delegate that has personal, family, business, monetary interest not vote on matter and debate.

DELEGATE LEONARD TSOSIE
Conflict of Interest prohibits participation and you all said that this is final committee and you all argued that this is committee so we are being misguided by attorneys. I believe when returns to court that judge probably rule that shareholders are same person as delegate and shareholder extends to them. They can’t change hat and run in as shareholder or delegate. I believe this will be an invalid action. And people will question. And since you, speaker pro temp Smith allowed, we shud all turn in stipend instead of wasting time. Attorneys are wrong. They are authorizing to proceed even though conflicts with Supreme Court decision. So I ask you, Speaker Pro Temp Smith, to rule and I was trying to state for integrity of this body to proceed according to law so permit me to raise that Kenneth Maryboy as delegate and shareholder shud not be allowed to vote and ask remaining Delegates Charles Damon II, Mel Begay, Rusell Begaye, Leonard Tsosie also to not be allowed to vote.
And then ask for Speaker Pro Temp Smith to declare Legislation 0352-13 out of order.

Sounds like Delegate Tsosie is talking to judge and that is hwy he called out each of our names.

Ask for Navajo Oil and Gas Company Perry Shirley to answer questions specifically to charter.

Point of Order: Mr. Shirley cannot act in any capacity to promote this legislation because of court order. This is a clear violation of court order. And I’m not speaking to judge. I’m just putting on record. Shirley is Board president and he purporting to take action on document for Navajo Oil and Gas.

We don’t want anyone to be held in contempt and liable. Since u recognized me, Mr. Speaker, table until this part gets resolved. Presenters might say something they are not suppose to say. And this Legislation can return during Special Session in two weeks. So there is time.

couple of things, and someone cud correct me if wrong. part of court order was for meeting of parties involved so ask shareholders if meeting happened. some saying did but if didn’t then i support tabling. also ask for directive to shareholders and Navajo oil and gas and others to meet to resolve issues. and if no resolution then we deal with Legislation 0352-13 at next special session.

sponsor asked for clarification and meeting took place, letters and emails sent to come to table. we have list of all invitees to be at meeting. started meeting, had agenda and all parties invited. we had court reporter there to record everything based on agenda to make sure that everyone invited on court order list had change to speak. invitations went out and some responded but not all. we keep sending invitations but don’t show up. Some of invitees held up court order and said they wud not attend cuz violate court order. Speaker Naize generated meeting.

Hate to say this but Delegate Begaye lying. Invitation before Speaker Naize from Navajo Oil and GAs CEO Robert Joe who threatened to remove shareholders/board members.
