I have no choice but to deny Deschene’s motion for dismissal from Deschene’s attorneys because Supreme Court ordered Office of Hearings and Appeals and I deny default motion from attorneys for Dale Tsosie and Hank Whitethorne.

Lunch break and at 1 P.M., counsels for both parties need to decide if Deschene takes test otherwise attorneys for Tsosie and Whitehorne will question Deschene.
